Becoming pregnant from illegal sexual intercourse
Qn19: I have become pregnant from illegal intercourse and I am suffering some complications with this pregnancy. Is it permissible for me to enquire about the fetus because I am not yet forty days pregnant. If it is not permissible and Allaah has willed for me to remain pregnant and give birth, who is this child attributed to? Should he be named after the father despite the fact that the father doesn’t want to marry me? If not, who? If the father marries me, is the child ascribed to the father?
Ans.19: If the fetus is just a clot, the creation hasn’t come into it yet, then it is permissible for you to abort it because in this action there is a benefit for you in the Shari’ah which is concealing your mistake. But it has been created, then it is not permissible for you to abort it; rather you should stay with your family and they should care for you until the birth of the child and not harm either of you. But after the delivery of the child, it is permissible for them to reprimand you unless you have repented then it is not permissible for them to reprimand you. As for the ascription of the child, then it is ascribed to you – he inherits from you and you inherit from him. I advise brothers to marry you as this would assist you in your piety and goodness and Allaah Knows Best.
